The legal grounds for the data processing

The contract on the provision of services

The purpose of the data processing

The provision of legal services in accordance with the contract concluded with the client

The recipients of the personal data

The public authorities (for example courts, administrative bodies)

Any other recipients according to the client’s needs and instructions

The personal data processing period

The personal data will be processed throughout the duration of the aforementioned contract and will then be handled in accordance with the valid legislation, especially Act no. 85/1996 Coll. (the Advocacy Act), Act no. 499/2004 Coll. (the act governing archives and file services and amending some other acts) and Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and abolishing Directive 95/46/EC (General Data Protection Regulation), once the contract ceases to be valid.

The rights of the client

The right to access the personal data (the client has the right to receive information from the administrator-lawyer as to whether said administrator is processing the client’s data and, if so, which information is involved and how it is being processed. The client is also entitled to request the administrator-lawyer to correct any inaccurate information in the personal data which pertains to the client without any undue delay. The client is entitled to add any missing data at any time).

The right to the deletion of the personal data (the obligation of the administrator-lawyer to delete the personal data which it has been processing in relation to the client, provided certain conditions have been met and the client so requests).

The client is entitled to request the administrator-lawyer to limit the processing of his or her personal data in certain cases (the client is entitled to lodge an objection against any processing, which is based on the justified interests of the administrator-lawyer or a third party or which is essential for the realisation of acts undertaken in the public interest or during the performance of public authority, and may do so at any time).

The right to the transferability of the data (the client’s ability to acquire the personal data, which he or she has submitted to the administrator, in a regular and machine readable format. The client may then submit this data to another administrator or, if it is technically possible, request the administrators to transfer it among themselves. The client’s right to withdraw his or her consent to process the personal data at any time is not applied, because the client’s personal data is processed on the basis of the performance of the contract which has been concluded with the client and not on the basis of consent for processing).

If the client is in any way dissatisfied with the manner in which the administrator-lawyer has processed his or her personal data, he or she can submit a complaint directly to the administrator or can contact the Office for Personal Data Protection.

More information about the client’s rights is available online at the website of the Office for Personal Data Protection. (https://www.uoou.cz/6-prava-subjektu-udaj/d-27276)
